The striker had his contract terminated in 2013 and ever since then has been embroiled in a series of court cases.
Now FIFA arbitration ruled that Zarate was in the wrong when he tried to interrupt his time at Lazio with a year left to run on the contract.
The Argentine must therefore pay €5.3m compensation, plus €300,000 interest.
Current West Ham forward Zarate can now appeal, but has 30 days to pay the Biancocelesti.
